Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Aura Tracker ("we", "us", "our"), operator of the Aura Tracker mobile application and associated website (collectively, the "Service").

By downloading, installing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree, you must not use the Service.

You must be at least 16 years old to create an account and use Aura Tracker. In compliance with Article 8 of the General Data Protection Regulation (GDPR – EU Regulation 2016/679), users between the ages of 13 and 15 may only use the Service with verifiable parental or guardian consent.

By using the Service, you represent and warrant that you meet these age requirements. We reserve the right to suspend or delete any account where age eligibility cannot be confirmed.

Aura Tracker is a social gamification application that allows users to:

• Create or join groups and compete on real-time leaderboards
• Vote democratically on "aura" points awarded to other group members
• Play mini-games (e.g. Connect 4) to earn additional points
• Send and receive wishes and compete for badges and tiers
• Communicate via group chat
• Participate in daily roulette draws for bonus points

The Service is provided on a free-to-use basis. We reserve the right to introduce optional paid features at any time, with prior notice to users.

To access core features, you must create an account. You agree to:

• Provide accurate, complete, and current registration information
• Maintain the confidentiality of your login credentials
• Notify us immediately of any unauthorised use of your account at contact@auratracker.tech
• Be solely responsible for all activities that occur under your account

We reserve the right to refuse registration or terminate accounts at our sole discretion, particularly in cases of violation of these Terms.

You retain ownership of content you submit (messages, votes, usernames, profile pictures – "User Content"). By submitting User Content, you grant Aura Tracker a worldwide, non-exclusive, royalty-free licence to use, store, reproduce, and display that content solely for the purpose of operating and improving the Service.

You agree not to post, transmit, or otherwise make available any content or behaviour that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or discriminatory
• Incites violence, hatred, or discrimination based on race, ethnicity, gender, religion, sexual orientation, disability, or any other protected characteristic
• Infringes any third-party intellectual property, privacy, or other rights
• Contains malware, spam, or unauthorised advertising
• Involves impersonation of another person or entity
• Violates any applicable law or regulation, including French law and EU law

We operate a content moderation system. We may, without prior notice, remove content that violates these rules and suspend or permanently ban accounts responsible. Users may report illegal or harmful content via contact@auratracker.tech. In accordance with the Digital Services Act (Regulation (EU) 2022/2065), we will process such reports diligently and provide feedback on the outcome.

Aura Tracker has a zero tolerance policy for objectionable content and abusive users. Any content that violates these Terms will be removed and the responsible account will be permanently ejected within 24 hours of a verified report.

We maintain a zero-tolerance approach to objectionable content and abusive behavior. Violations will result in immediate content removal and permanent account termination.

You may not use the Service to:

• Reverse engineer, decompile, or attempt to extract source code
• Use automated tools (bots, scrapers) to interact with the Service without our written consent
• Manipulate votes, leaderboards, or game mechanics in bad faith
• Sell, transfer, or commercially exploit your account or any part of the Service
• Collect personal data of other users without their consent
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure

All rights, title, and interest in and to the Service (excluding User Content), including its design, graphics, code, trademarks, and brand elements, are and remain the exclusive property of Aura Tracker. Nothing in these Terms transfers any intellectual property rights to you.

You are granted a limited, revocable, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes only.

We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679) and the French Data Protection Act (Loi Informatique et Libertés n°78-17). Your rights as a data subject include:

• Right of access (Article 15 GDPR)

The Service is distributed via the Apple App Store. Your use of that platform is subject to Apple's Terms and Conditions. We are solely responsible for the content and operation of the Service. Apple is not a party to these Terms and has no obligation whatsoever with respect to the Service.

The Service may also integrate third-party analytics or infrastructure providers. These providers act as data processors under GDPR and are contractually required to protect your data.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

Nothing in this clause limits any statutory rights you may have under applicable EU consumer protection law, including Directive 2011/83/EU.

To the maximum extent permitted by applicable law, Aura Tracker and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us (if any) in the twelve (12) months prior to the event giving rise to the claim. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under French or EU law.

You may delete your account at any time through the application settings. Upon account deletion, your personal data will be processed in accordance with our Privacy Policy.

We may suspend or terminate your access to the Service immediately, without prior notice, if we reasonably determine that you have violated these Terms. We will notify you of the reason where legally permissible. You may appeal a termination decision by contacting contact@auratracker.tech within 30 days.

The App provides the following moderation tools: (a) a built-in profanity and offensive content filter that automatically blocks prohibited content before it is published; (b) a "Flag" button on every user profile and message to report objectionable content; (c) a "Block" button to immediately remove a user's content from your feed and notify the developer; (d) administrator tools to remove group members. Reports are reviewed within 24 hours. Confirmed violations result in immediate content removal and permanent account ejection.

We may update these Terms from time to time to reflect changes in our Service, applicable law, or business practices. When we make material changes, we will notify you via a prominent notice in the application or by email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the Service and may delete your account.

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict-of-law principles. For consumers residing in another EU Member State, you also benefit from any mandatory consumer protection provisions of the law of your country of residence.

In the event of a dispute, you are encouraged to first contact us at contact@auratracker.tech so that we can attempt to resolve the matter amicably. You may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

If no amicable resolution is reached, disputes shall be submitted to the exclusive jurisdiction of the competent courts of France, unless mandatory law grants you jurisdiction in your country of residence.
